Programme Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the online learning content, courses, eBooks, programmes, and resources (collectively, the "Content") provided by WNutrition Pty Ltd (ABN [INSERT ABN]) ("we," "us," or "our"). By purchasing, accessing, or using our Content, you agree to these Terms. Please read them carefully.
If you do not agree to these Terms, you should not purchase, access, or use our Content.
1. Eligibility
You must be at least 18 years of age to purchase or access our online programmes, courses, and resources. By purchasing or accessing our Content, you confirm that you are 18 years or older. Our online programmes are not designed for, or directed at, persons under 18. Where a person under 18 requires nutritional support, this must be arranged directly with Sharon Carius as a separate clinical engagement.
2. Nature of Our Services
WNutrition provides services that fall into three categories, which carry different relationships and responsibilities:
- Self-paced educational content - including standalone online courses, eBooks, recordings, and downloadable resources. This Content is general in nature, is provided for educational and informational purposes only, and does not constitute personal clinical advice. It is not tailored to your individual circumstances, and no practitioner-client relationship is formed by your purchase or access.
- One-to-one clinical consultations - personalised consultations and programmes delivered by Sharon Carius as a practising Clinical Nutritionist. These are individualised clinical services and are governed by the specific arrangements made with you at the time of engagement, in addition to these Terms.
- Hybrid programmes - certain programmes (for example, our 12-week programme) combine self-paced educational content with included one-to-one clinical consultations and, where specified, pathology testing. Where a programme includes one-to-one clinical consultations with Sharon Carius, those consultations form a clinical engagement and are treated as one-to-one clinical services under category 2 above, while the self-paced materials within the same programme remain educational content under category 1.
The inclusions of each programme are described on its product page. Where pathology testing is included in a programme, it is arranged and priced as part of that programme. Pathology results are used solely to inform and personalise your nutritional programme (for example, to generate a Metabolic Balance® plan). They are not reviewed, interpreted, or assessed by us to diagnose, exclude, or monitor any medical condition. Any diagnostic interpretation of your results remains the responsibility of your treating medical practitioner.
Unless you have entered into a one-to-one clinical engagement with us (whether on its own or as part of a hybrid programme), your use of our Content is on the basis of self-paced educational content only.
3. Use of Content
The Content is intended for educational and informational purposes only. It is not a substitute for medical advice, diagnosis, or treatment. Always consult your healthcare provider before making significant changes to your diet, lifestyle, or health plan.
You agree not to share, copy, reproduce, or distribute the Content without our prior written consent.
At no time can any of the images, resources, videos, concepts or Content be shared, copied, embedded or resold without our prior written consent. All designs, resources, media and content presented on any of the websites owned by Sharon Carius (WNutrition) are copyright to WNutrition. These sites include:

4. Important Health Disclaimer
Before making any changes to your lifestyle, nutrition, or health practices, you should first consult your primary healthcare provider to ensure the suitability of our programmes and resources. Our self-paced educational services are designed to provide general education and guidance only - they are not a replacement for professional medical advice, diagnosis, or treatment.
You should always remain under the care of your healthcare provider, especially if you are managing a health condition, are pregnant, breastfeeding, or suspect you may have a medical issue.
WNutrition, along with its employees, agents, and authors, accepts no liability for any loss, injury, or damage (including physical, emotional, or mental) that may occur as a result of using, reading, or applying the information contained in our programmes, eBooks, online courses, podcasts, products, or social media content, except to the extent that such liability cannot be excluded under the Australian Consumer Law.
Our resources do not remove personal responsibility for your own health decisions. None of our self-paced Content is intended to treat, cure, or diagnose any medical condition. You should never disregard, delay, or discontinue advice from your healthcare provider because of information you have read or accessed through our website, eBooks, programmes, or social media platforms.
5. Your Australian Consumer Law Rights
Our Content and services come with guarantees that cannot be excluded under the Australian Consumer Law ("ACL"). Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the ACL or any other applicable law that cannot lawfully be excluded or limited.
Where our liability for a failure to comply with a consumer guarantee can be limited (and the guarantee is not one that the ACL prohibits us from limiting), our liability is limited, at our option, to:
- in the case of services - resupplying the services, or paying the cost of having the services resupplied; and
- in the case of goods (including digital products) - replacing the goods, supplying equivalent goods, or paying the cost of replacement.
To the fullest extent permitted by law, and subject to your rights under the ACL, we otherwise disclaim all liability for any loss, injury, or damages arising from the use of our Content.
6. Access and Availability
We make every effort to ensure uninterrupted access to our Content, but we cannot guarantee that our website or online platforms will always be available or error-free. We reserve the right to modify, suspend, or discontinue any part of the Content at any time without prior notice.
7. Third-Party Platforms
Our Content, payments, and bookings are delivered and processed through third-party platforms, including Kajabi (course delivery), Cliniko (bookings), and Stripe, Afterpay, and other payment processors. While we select reputable providers, we are not responsible for the availability, performance, security, or conduct of these third-party platforms. Your use of those platforms may be subject to their own terms and conditions, and any outage, error, or failure of a third-party platform is outside our control. To the extent permitted by law, and subject to your rights under the ACL, we disclaim liability for loss or damage arising from third-party platform failures.
8. Copyright and Intellectual Property
All Content (including text, graphics, videos, documents, and course materials) is owned by WNutrition and protected by copyright and intellectual property laws. You are granted a limited, non-transferable licence to use the Content for personal, non-commercial purposes only.
9. Payments, Pricing & Refunds
All payments are processed via Kajabi and its payment processors. All fees for paid programmes, courses, or resources must be paid in full at the time of purchase unless otherwise agreed in writing or unless you select a buy now, pay later option at checkout (see "Buy Now, Pay Later" below).
Prices advertised on the website are in Australian Dollars unless otherwise noted. Payment permits one (1) person only to access the purchased course, event, or resource. All third parties - including, but not limited to, business partners, colleagues, assistants, and your clients - must purchase their own access.
Refund policies, where they apply, will be clearly stated on the relevant product or course page. Because our digital products and programmes provide immediate access to downloadable and viewable materials, they are generally not eligible for a refund once access has been granted, except where a refund is required under the Australian Consumer Law (for example, where a consumer guarantee has not been met). Nothing in this section limits your non-excludable rights under the ACL.
10. Buy Now, Pay Later (Afterpay)
We offer Afterpay for some programmes as a payment option at checkout through Kajabi. Afterpay is a third-party "buy now, pay later" service. If you choose to pay using Afterpay:
- Your instalment arrangement is a separate agreement between you and Afterpay, governed by Afterpay's own terms and conditions. It is not a payment plan offered or administered by WNutrition.
- WNutrition receives payment for your purchase upfront and in full from Afterpay. You then repay Afterpay directly according to your arrangement with them.
- Any fees, charges, late fees, or collections activity associated with your Afterpay arrangement are a matter between you and Afterpay. WNutrition is not a party to that arrangement and is not responsible for it.
- Your access to the purchased programme is granted on the same basis as any other purchase, regardless of whether you pay in full or via Afterpay.
You should review Afterpay's terms and ensure the arrangement is suitable for you before selecting it at checkout.
11. Affiliate Links and Material Connections
From time to time, our websites or communications may contain affiliate links, or we may recommend third-party products or services from which we receive a commission or other benefit. Where we have a material connection of this kind, we will disclose it in accordance with the Australian Consumer Law. Any purchase you make through a third-party or affiliate link is a transaction between you and that third party, on their terms, and we accept no liability for those products, services, or third parties. A recommendation does not constitute clinical or professional advice unless expressly stated.
12. Membership, Course Access & Conduct
Upon purchase of a course or membership you will be granted access to the applicable membership site and course purchased. If you cancel or deactivate your account with WNutrition or with kajabi.com, your access to the courses and membership sites will be deactivated and removed. You will need to re-purchase to reactivate any lost access following a self-deactivation of your account.
On all live trainings, the membership sites, and in any membership calls or communities, you will conduct yourself in a professional and respectful manner at all times. Any bullying, harassment, discriminatory conduct, X-rated material, or inappropriate comments or behaviour will be considered a breach of these Terms. In such an event, your access to the course and communities may be terminated. Where access is terminated for serious misconduct, no refund will be payable except to the extent required under the Australian Consumer Law.
Live training may involve recording of the video training, where your name, face, voice, and comments can be seen by other course members - present and future. If you do not wish to be visible in recordings, please turn off your webcam and rename your profile for the duration of the call. Other terms and conditions may apply to any online group (e.g. Slack, Kajabi, Teams, Facebook Group) hosted by Sharon Carius or WNutrition. Please review the relevant group guidelines prior to entry.
You are not permitted to share your course login or membership details with another person, or to allow another person to watch the course content, read the course material, or access any events. The third party must purchase their own access.
13. User Responsibilities
You agree to use our Content in a respectful and lawful manner. You may not upload, share, or transmit viruses, harmful code, or offensive material through our platforms.
14. Privacy
We handle personal information in accordance with the Australian Privacy Principles under the Privacy Act 1988 (Cth). Health information you provide is treated as sensitive information and handled accordingly. Where a programme includes pathology testing, testing is carried out by a third-party pathology provider, and your information is handled in accordance with that provider's privacy obligations as well as our own. For details on how we collect, use, store, and disclose your information, please refer to our Privacy Policy, which forms part of these Terms.
15. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland and the Commonwealth of Australia.
16. Changes to Terms
We may update these Terms at any time. The "last updated" date below reflects the most recent version. Continued use of our Content after changes are posted constitutes your acceptance of the revised Terms.
